RHODE ISLAND CRIMINAL DEFENSE
probation violations
When your freedom is at stake, experience matters.
A probation violation is not simply another criminal charge. It is a separate legal proceeding with its own rules, procedures, and potentially serious consequences. Defending against an alleged violation requires more than a general understanding of criminal law. It demands familiarity with the courts, the applicable legal standards, and the strategic considerations that can influence the outcome.
With more than a decade of experience practicing in Rhode Island's criminal courts, Chelsea Kelly brings a knowledgeable, strategic, and creative approach to defending individuals facing probation violations.
A DIFFERENT STANDARD. SERIOUS CONSEQUENCES.
Under Rule 32(f) of the Rhode Island Rules of Criminal Procedure, the State need not prove guilt beyond a reasonable doubt to establish a probation violation.
Instead, the State must show by a fair preponderance of the evidence that an individual violated a condition of probation or failed to keep the peace and remain on good behavior.
This burden is significantly lower than the standard required for a criminal conviction. A person may therefore be found in violation of probation based on conduct that has not resulted in a criminal conviction.
The consequences can be substantial, including the possibility of incarceration on a previously suspended sentence. Understanding the distinction between a criminal prosecution and a probation violation proceeding is essential to developing an effective defense.
experience beyond the law.
Knowing the procedure is only half of the equation. Knowing how to navigate this system matters just as much.
Probation violations raise complex procedure questions, may overlap with criminal charges, and can carry serious penalties. Handling them takes careful review of the allegations, knowledge of legal defenses, and spotting chances for better outcomes.
Chelsea’s wide courtroom experience lets her handle these cases with accuracy and creativity. She looks beyond the obvious, builds alternative strategies, finds missed opportunities, and pushes for solutions that fit each client.
Her work blends clear knowledge of Rhode Island criminal procedure, hands-on courtroom skill, smart negotiation, and a firm focus on protecting clients’ futures.
your future deserves a strategic defense.
An allegation of violating probation does not automatically mean that incarceration is inevitable. Every case presents different facts, legal considerations, and potential avenues for resolution.
