THE STATE MUST PROVE MORE THAN SIMPLY FINDING DRUGS

FINDING DRUGS DOES NOT AUTOMATICALLY ESTABLISH GUILT

To convict you of a drug crime, the state must prove each of these beyond a reasonable doubt:

  • You knew you had the drug.

  • You could control the drug and intended to control it.

  • You had the required mental state (for example, knowingly or intentionally).

Possession can be shown in two ways:

  • Actual possession: the drug was on your person.

  • Constructive possession: the drug was in a place you controlled (home, car, locker).

Failure to prove these elements = NOT GUILTY.

WAS THE SEARCH LEGAL?

MANY DRUG CASES HINGE ON WHETHER LAW ENFORCEMENT FOLLOWED THE LAW.

WE EXAMINE EVERY DETAIL OF HOW EVIDENCE WAS OBTAINED.

  • Searches following Consent

  • Police Pat Down / Frisk Search

  • Cell Phone Searches

  • Traffic Stops

  • Vehicle Searches

  • Search Warrants

Every drug case must begin by checking whether the police followed the Constitution — and that check is the most important step in the defense.

Why it matters:

  • If police violated constitutional rights, key evidence may be excluded. Without that evidence, prosecutors often cannot prove the charges.

  • Every person has constitutional protections against unlawful stops, searches, seizures, arrests, and interrogations. Violations include stops without reasonable suspicion, searches without a warrant or valid exception, and arrests without probable cause.

A DRUG CHARGE DOES NOT HAVE TO DEFINE YOUR FUTURE

Early legal representation can help preserve evidence, identify legal issues, and explore every available defense or alternative resolution.
